00012<\/p>\n<p>The purchase of a pass implies the customer\u2019s knowledge and acceptance of the entire present General Terms and Conditions of Sale and Use (CGVU), without prejudice to the usual means of recourse.<\/p>\n<p>If any provision of these conditions is found to be lacking, it shall be considered as governed by the practices in force within the ski lift industry for companies based in France.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-79de212 elementor-widget elementor-widget-heading\" data-id=\"79de212\" 1: The Pass<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-43d0a56 elementor-widget elementor-widget-text-editor\" data-id=\"43d0a56\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The pass consists of a support on which a transport ticket is registered.<\/p>\n<p>The pass grants access to the ski area of ROC d&#8217;ENFER (for Roc d&#8217;Enfer passes) and to the ski area of the Portes du Soleil (for Portes du Soleil passes).<\/p>\n<p>Passes with a duration longer than the shortest duration offered are strictly personal, non-transferable, and non-assignable.<\/p>\n<p>For children under 5 years old, the pass is free; the accompanying person must request a free transport ticket for the child and must be able to provide proof of the child\u2019s age at the ticket check.<\/p>\n<p>The 5-hour pass: the time count starts as soon as the first control gate is passed. The user is responsible for ensuring the validity of their pass during the time spent on the ski area.<\/p>\n<p>The pass is only valid for the current season, and therefore loses its validity at the end of the season.<\/p>\n<p>Pass checks are carried out by passing through the control gates or the iPads designated for this purpose at the lift departure points.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ff88d78 elementor-widget elementor-widget-heading\" data-id=\"ff88d78\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 2: The Media<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c83292 elementor-widget elementor-widget-text-editor\" data-id=\"2c83292\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Transport tickets are issued on the following supports:<\/p>\n<p>&#8211; Single-use free support: Round-trip pedestrian, One-way pedestrian, and Return pedestrian.<br \/>\n&#8211; Rechargeable support, for which the client is charged (3 Euros) for all other passes.<br \/>\n&#8211; Passes for children under 5 years old (free) and adults over 75 years old (free) must be issued on rechargeable supports.<br \/>\n&#8211; Loyalty points obtained during promotional events can only be loaded and used on a &#8220;rechargeable&#8221; support.<\/p>\n<p>Rechargeable supports are reusable one or more times, within a warranty period of 3 years.<\/p>\n<p>The warranty applies only in cases of normal use of the support and consists of issuing a new support to replace the defective one. The client will be responsible for reloading the &#8220;Soleils&#8221; from their Portes du Soleil loyalty program by logging into their personal &#8220;My Club Portes du Soleil&#8221; account.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-de12701 elementor-widget elementor-widget-heading\" data-id=\"de12701\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 3: Photography<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-34cfdd8 elementor-widget elementor-widget-text-editor\" data-id=\"34cfdd8\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The sale of passes with a duration of more than 7 days is subject to the submission of a recent passport-style photograph, taken from the front, without sunglasses or headgear.<\/p>\n<p>This photograph will be stored by Team Axess in its ticketing system to facilitate any future reloading or re-issuance of the Ticket.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-99ae84e elementor-widget elementor-widget-heading\" data-id=\"99ae84e\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 4: PRICES \u2013 Discounts and Free Passes (Children Under 5 and Adults Over 75) or Customer Categories and Rates.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-667a819 elementor-widget elementor-widget-text-editor\" data-id=\"667a819\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>All public prices for passes, transport tickets, and supports are displayed at the sales points. These prices are expressed in euros, including all taxes.<\/p>\n<p>They are also listed in the &#8220;trail map&#8221; brochure (for Roc d\u2019Enfer passes), on the website www.rocdenfer.com, and on skipass.rocdenfer.com.<\/p>\n<p>Discounts or free passes are offered to various categories of people according to the terms available at the sales points and upon presentation of documents justifying the discount at the time of purchase. No discounts will be granted after the purchase.<\/p>\n<p>The customer&#8217;s age to be considered will be determined as follows:<\/p>\n<p>&#8211; For day pass(es): the day the pass becomes valid.<br \/>\n&#8211; For season pass: the year of birth.<br \/>\nOnly the rates available at the administrative offices are official.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f5dd181 elementor-widget elementor-widget-heading\" data-id=\"f5dd181\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 5: PRICES \u2013 Payment Methods.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd1ec4b elementor-widget elementor-widget-text-editor\" data-id=\"cd1ec4b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Payments are made in euros:<\/p>\n<p>&#8211; Either by cheque drawn on a bank account opened in France, issued to the order of the company: SAEM Roc d\u2019Enfer.<br \/>\n&#8211; Or in cash.<br \/>\n&#8211; Or by credit card accepted by SAEM Roc d\u2019Enfer.<\/p>\n<p>Note: Foreign cheques cannot be used as a payment method.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-554750d elementor-widget elementor-widget-heading\" data-id=\"554750d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 6: Proof of Purchase.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3a57214 elementor-widget elementor-widget-text-editor\" data-id=\"3a57214\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Each pass issuance results in the delivery of a sales receipt, which includes:<\/p>\n<p>&#8211; Date of purchase<br \/>\n&#8211; Transaction number<br \/>\n&#8211; Cash register number<br \/>\n&#8211; Type of pass<br \/>\n&#8211; Quantity of passes purchased<br \/>\n&#8211; Pass number<br \/>\n&#8211; Insurance, if applicable<br \/>\n&#8211; Total amount including tax<\/p>\n<p>This receipt must be kept carefully and presented as supporting documentation for any request or complaint.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f1e9e15 elementor-widget elementor-widget-heading\" data-id=\"f1e9e15\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 7: Pass Control.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e0eb3b elementor-widget elementor-widget-text-editor\" data-id=\"4e0eb3b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Absence of pass \u2013 Invalid transport ticket. Failure to comply with police regulations. Failure to comply with decrees, particularly those specifying or prescribing general measures to address public health emergencies.<\/strong><\/p>\n<p>The customer must carry their pass throughout the entire journey on the ski lift, from the departure area to the arrival area.<\/p>\n<p>The absence of a pass, the use of an invalid transport ticket, or failure to comply with the police regulations posted at the lift departure points, as observed by a controller, will result in:<\/p>\n<p>&#8211; Either the payment of a fixed fine that extinguishes public action. This fixed fine is equal to FIVE times the value of the daily transport ticket corresponding to the ski lift network in question (Roc d\u2019Enfer ski area for a Roc d\u2019Enfer pass, Portes du Soleil ski area for a Portes du Soleil pass), plus, if applicable, any administrative fees, the amount of which is set by the applicable regulations (Articles L342-15, R342-19, and R342-20 of the Tourism Code, Articles 529-3 and following of the Criminal Procedure Code, and Article L2241-36 of the Transport Code);<br \/>\nControllers may request the presentation of any documents justifying the discounted or free fare benefits granted to the holder of a reduced or free transport ticket.<br \/>\n&#8211; Or legal action.<br \/>\nControllers may request the presentation of any documents justifying the discounted or free fare benefits granted to the holder of a reduced or free transport ticket.<br \/>\nIf the offender refuses or is unable to justify their identity, the controller must immediately report the matter to any judicial police officer of the competent national police, who may then instruct the controller to immediately present the offender.<\/p>\n<p>The controller may also immediately confiscate the pass in order to return it to its rightful owner.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-01e893d elementor-widget elementor-widget-heading\" data-id=\"01e893d\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 8: Loss \u2013 Theft of the Pass.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a99c011 elementor-widget elementor-widget-text-editor\" data-id=\"a99c011\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In case of loss or theft, and upon presentation of the <strong>SALES RECEIPT<\/strong>, a new pass will be issued for the remaining duration.<\/p>\n<p>The customer must go to a sales point at the Roc d\u2019Enfer ski area.<br \/>\nThe customer must present the sales receipt (an ID will be required for season passes).<br \/>\nIf the transport ticket was issued on a rechargeable support, the customer must purchase a new support at the current rate.<br \/>\nLost or stolen passes will be deactivated.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4478bcb elementor-widget elementor-widget-heading\" data-id=\"4478bcb\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 9: Interruption of the Ski Lifts.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9867b82 elementor-widget elementor-widget-text-editor\" data-id=\"9867b82\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Only a complete shutdown of more than half a day, affecting more than 80% of the ski lifts on the Roc d\u2019Enfer ski area, may entitle the customer to compensation for the inconvenience suffered, upon presentation of their pass and the completion of a compensation request form, which can be obtained at the St Jean d\u2019Aulps or La Ch\u00e8vrerie sales points.<\/p>\n<p>The supporting documents, along with the compensation request form, must be sent to SAEM Roc d\u2019Enfer, 32 Route de la T\u00e9l\u00e9cabine, 74430 St Jean d\u2019Aulps, or by email to regie@rocdenfer.com within 30 days.<\/p>\n<p>This compensation can take the following forms, at the customer&#8217;s choice:<\/p>\n<p>&#8211; Either an immediate extension of the validity of the transport ticket;<br \/>\n&#8211; Or a credit for five hours or a full day (depending on the type of pass purchased), to be used no later than March 31, 2023;<br \/>\n&#8211; Or a delayed refund corresponding to the number of days of closure, multiplied by the price of the purchased pass, adjusted to the number of days the pass was valid during the operation period, minus a one-day waiting period at the current base rate.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dc94528 elementor-widget elementor-widget-heading\" data-id=\"dc94528\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 10: Force Majeure \u2013 Conditions for Compensation.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6f976ac elementor-widget elementor-widget-text-editor\" data-id=\"6f976ac\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>A force majeure event is defined as any unforeseeable, irresistible, and external event, beyond the control of the parties, such as those typically recognized by the case law of French courts, including but not limited to, administrative closure due to a pandemic, government or legal restrictions, legal or regulatory changes preventing the parties from continuing their activities, and telecommunications blockages.<\/p>\n<p>In the event of a shutdown of all ski lifts due to a force majeure event resulting in a suspension of the contract for more than 15 consecutive days, winter season passes for 2020\/2021 giving access to the area may be eligible for a refund corresponding to the number of weeks of closure, multiplied by the price of the season pass, adjusted to the number of weeks of operation initially scheduled, minus a one-day waiting period at the current base rate.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1db3ab8 elementor-widget elementor-widget-heading\" data-id=\"1db3ab8\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Article 11: Refunds.<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-564ff9c elementor-widget elementor-widget-text-editor\" data-id=\"564ff9c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In the case where the transport tickets issued are not used or not fully exhausted, they will neither be refunded nor exchanged.<\/p>\n<p>Non-consecutive day passes must be used during the current season; beyond that, they cannot be used, and no refund or validity extension will be provided.<\/p>\n<p>It is possible to cover this type of risk with specific insurance.
